Copyright and Restrictions

Worthington Memory is offering public access to these materials for educational and research purposes only. These digital collections are maintained by Worthington Libraries, however the Library does not own rights over these materials. Therefore, Worthington Libraries does not charge permission fees for use of such material and cannot give or deny permission to publish or otherwise distribute material in the Worthington Memory collection. Most of the published materials digitized for this electronic collection date from before 1923 and are presumed by Worthington Memory to be in the public domain. However, some materials may be protected by U.S. Copyright Law (Title 17, U.S.C.). Reproduction of protected items beyond that allowed by fair use requires the written permission of the copyright owners. It is the patron's obligation to determine and satisfy copyright or other use restrictions when publishing or otherwise distributing materials found in Worthington Memory. Researchers must make their own assessments of rights in light of their intended use.

Fair Use

What is "fair use"?

Fair use is an exception to the exclusive protection of copyright under American law (http://lcweb.loc.gov/copyright/title17/). The fair use provision allows limited use of copyrighted materials under certain conditions, for example research, instruction and private study.

The following factors must be considered in determining whether a specific use falls under fair use:

  • the purpose and character of the use, (for example is the use of a commercial nature or is it for nonprofit educational purposes);
  • the nature of the copyrighted work;
  • the amount and substantiality of the work being used;
  • the effect of the use upon the potential market for and value of the original.
Users assume all liability for copyright infringement and are advised to contact the contributing institution or individual holding the source materials for copyright information and permission to use the electronic versions. Permission must be obtained for display, publication, commercial use, or any other use of the digital materials in this collection except as allowed under fair use.
